This Privacy Notice was created by W.Y. – SGPS, S.A. (hereinafter referred to as “WYgroup”, “we”, “us”, and “our”) to demonstrate that we respect the privacy of all users of WYgroup websites and to recognize that when you choose to provide us with information about yourself, you trust us to act in a responsible manner with that information.

WYgroup may request that you supply us with Personal Information. Generally, this information is requested when you voluntarily want us to provide you with information. Information that we may gather about you when you use this website:

Personal Data

1.   Identity Data includes first name and last name.

2.   Contact Data means the data we use to contact you including your Country, address, email address and telephone number.

4.   Usage Data means we may also collect information how the Service is accessed and used (“Usage Data”). Retention Period

In the event that WYgroup is treating and using your Personal Data in a manner permitted by law or with your consent, WYgroup will store your information only for the time required to fulfill the purposes set forth above, or until you raise an objection as to whether WYgroup uses your Personal Data (when WYgroup has a legitimate interest in the use of your Personal Data), or until such time as you withdraw your consent (when you have consented that WYgroup uses your Personal Data).

However, in cases where WYgroup is obliged by law to keep your Personal Data for a longer period, or when your Personal Data is required for WYgroup to lodge or defend against legal claims, WYgroup maintains your Personal Data until the end of the relevant retention period or until the claims in question have been resolved.

1.   Our third-party service providers who perform functions on our behalf in connection with the operation of the Sites e.g., providers who host and manage data;

We may disclose your Personal Data if we or any of our assets are the subject of a sale or similar corporate transaction. We will ensure that the third parties who receive your Personal Data are required to keep it confidential.

Data security

The web servers that WYgroup is running on are built using a modern web framework designed with security in mind. We follow best security practices, keep up to date with bugs and security patches and apply security updates to our systems in a very prompt manner. We have tools in place to detect abnormal behavior and have an internal security team responsible for keeping our security up to date.

Information and processing

As a global company, WYgroup has subsidiaries and external service providers inside and outside the European Union (the “EU”). As a consequence, whenever we use or otherwise treat your Personal Data for the purposes described in this Privacy Notice, we may transfer your information to countries outside the EU, including those where the level of data protection is not comparable to that applied in the EU.

Whenever such a transfer occurs, we will put in place appropriate safeguards (such as Standard Contractual Clauses, according to EU Commission Decision 87/2010/EC or any future replacement) to ensure your information is protected.

Rights of the Data Subject

You may request from us, at any time, information about what Personal Data WYgroup treats about you, and the correction or deletion of such Personal Data.

Please note, however, that WYgroup may only delete your Personal Data if there is no legal obligation or prevailing right on the part of WYgroup to maintain such Personal Information. Also note that if you request that WYgroup delete your Personal Data, you will not be able to continue to use any WYgroup service that requires us to use your Personal Data.

If WYgroup uses your Personal Data based on your consent or enters into a contract with you, you may also ask WYgroup for a copy of the Personal Data you have made available to WYgroup. In this case, please contact WYgroup through the email address dpo@wygroup.net and indicate the information or treatment activities to which your request refers, the format in which you would like to receive this information and if the Personal Data should be sent to you or another recipient. WYgroup will carefully consider your request and will decide together how best to comply with you. Please note that, for security reasons, WYgroup will have to ask you to provide information to confirm your identity.

In addition, you may request that WYgroup will prevent further processing of your Personal Data in the event of any of the following: (i) when you declare that the Personal Data that WYgroup holds about you is incorrect (but only as long as WYgroup requires to verify the accuracy of the relevant Personal Data); (ii) when there is no legal basis for the processing of your Personal Data by WYgroup and requires WYgroup to prevent further processing of your Personal Data; (iii) when WYgroup no longer requires your Personal Data, but you claim that you need WYgroup to retain such data in order to claim or exercise legal rights or defend yourself against third party claims; or (iv) when you object to the processing of your Personal Data by WYgroup (based on the legitimate interest of WYgroup), for as long as is necessary to verify whether WYgroup has an existing interest or obligation with respect to the processing of your Personal Data. Our policy towards children

This website is not intended or designed to attract children under the age of 16. We do not knowingly collect Personal Information from or about any person under this age. If you are under 16 years old and wish to ask a question or use this site in any way which requires you to submit your Personal Data, please get your parent or guardian to do so on your behalf.

Right to complain

If you believe that WYgroup is not processing your Personal Data in accordance with the requirements set out herein or with the applicable EU data protection legislation, you may at any time file a complaint with the data protection authority of the EU country where you reside, or with the data protection authority of the country or state where WYgroup has its registered office.

The data protection authority of the country where WYgroup has its registered office is CNPD – Comissão Nacional de Protecção de Dados (www.cnpd.pt).

Changes to this privacy notice

From time to time, WYgroup may need to update or modify this Privacy Notice, to reflect changes in our business practices, data collection practices or organization. We reserve the right to amend this Privacy Notice at any time, for any reason, without notice to you, other than the posting of the amended Privacy Notice on the websites. It is strongly recommended that you check the website often, referring to the date of the last modification listed at the top. We will in any case not reduce your rights under this Privacy Notice without your explicit and informed consent.

If you do not agree to the changes, you should discontinue your use of the website, and cease providing Personal Information to us, prior to the time the modified Privacy Notice takes effect. If you continue using the website or provide Personal Information after the modified Privacy Notice takes effect, you will be bound by the modified Privacy Notice.

Lawful Use of Personal Data

In the following cases, WYgroup is permitted to treat your Personal Data under applicable data protection law.

Ensure compliance

WYgroup and its products, technologies and services are subject to the legislation on exports from several countries, including in particular the laws of the European Union and its Member-States. You acknowledge that, under applicable export laws, trade sanctions and embargoes declared by these countries, WYgroup is required to take measures to prevent entities, organizations and partners, listed in sanctioned partner lists issued by government authorities, access certain products, technologies and services through the WYgroup web pages or other delivery channels controlled by WYgroup.

This may include (i) automatic verifications of all user registration data, as provided herein and other information provided by a user on his or her identity, regarding the sanctioned partner lists; (ii) regular repetition of such checks, whenever a list of sanctioned partners is updated or when a user updates their information; (iii) block access to WYgroup services and systems in the event of potential correspondence; and (iv) contact a user to confirm their identity in the event of a potential match.

In addition, you acknowledge that any information necessary to control your options regarding the handling or use of your Personal Data or receipt of marketing materials (i.e. depending on the country where the relevant company of the WYgroup operates, whether the user has expressly consented to or cancelled the receipt of marketing materials) may be archived and transmitted to WYgroup or Group members as necessary to ensure compliance.

Forwarding of your Personal Data to other WYgroup companies

WYgroup may transfer your Personal Information to other entities in the WYgroup. Please consult here the current list of WYgroup companies. In such cases, these entities will use your Personal Data for the same purposes and under the same conditions as summarized in this Privacy Notice.
